LEGISLATION OF RAWAKHOLA SEROFERO-UK (RKSF-UK)

 

INTRODUCTION

The organization is established in order to promote and maintain closer and mutual relationship among the members and their families of same province who are currently residing in the United Kingdom in a scattered manner, to promote a sense of belongingness among them and to promote the feelings of mutual cooperation in times of need. The organization is for all those that belong to the same area of Rawakhola Serofero-uk.

SECTION-I
1. Name and Affectivity
1.1 The organization shall be known as Rawakhola Serofero-UK and in short abbreviation shall be RKSF-UK.
1.2 The legislation shall be effective as per the agreement of Annual General Meeting of 07 Apr 2012 and as well as overwhelming approval of AGM of 06 Oct 2012.
1.3 The Logo of the organization is a combination of images and text. Organization official logo is at serial 35.
1.4 The organization:
1.4.1 Exists in its own right.
1.4.2 Continues to exist even when its members’ memberships change.
1.4.3 Will be able to own properties and other possessions.

2. Location
The organization was formed in the United Kingdom and Geographical border is set as below in order to accommodate membership of the organization.

3. Definition Unless otherwise indicated
3.1 “Rawakhola” is the name of a popular river which flows east to west in the northern region of ‘Khotang’ District, Nepal.
3.2 Serofero is a Nepalese word which means surroundings.
3.3 “Organization” shall mean Rawakhola Serofero Social Organization.
3.4 “Legislation” shall mean the ‘Written Rules’ which will be applied to all members of RKSF-UK.
3.5 “Executive Committee” shall mean the committee formed according to the Legislation of the Organization.

SECTION-II
4. Objective
The organization has set the following objectives:
4.1. To promote goodwill and mutual cooperation among the members of Rawakhola Serofero-UK who are currently residing in the United Kingdom in a scattered manner.
4.2. To raise tangible assets and materials in order to help and resolve emergency situations that may arise within our family members of RKSF-UK organization.
4.3. To promote and preserve Nepalese multicultural values by educating our younger generation about “who we are and where we come from”.

SECTION-III
5. Membership
5.1 One membership covers family members (husband, wife and their unmarried children).
5.2 Membership joining fees are as follows:
5.2.1 One-off Life Member = £50

5.2.1 Patron Member = £300.00

5.2.2 Distinguished member = £200.00 Only member selected by executive committee will hold the appointment and will be selected during the Annual General Meeting if required.
5.3 Every registered member has one voting right.
5.4 If the registered member pass away, clause 5.1 will apply.
5.5 If the organization is ceased to exist, membership will be automatically terminated.
5.5 If the member is disloyal to the organization, then his/her membership will be revoked.

6. Registered member support
Registered members’ financial support of £20 to the bereaved family is to be collected only in the following circumstances.
6.1 If a member’s death occurs in any part of the world within 3 months from UK departure date then he/she is qualified for members’ contribution.
6.2 If a member’s death occurs during medical treatment in any part of the world, there is no time limit for such cases; he/she is qualified for members’ contribution.
6.3 There will be no financial assistance from the organization to non-members.

SECTION-IV
7. General Assembly
The procedures for the General Assembly meeting shall be as follows:
7.1 The meeting of the General Assembly of the organization shall be held once a year in a compulsory manner, and as deemed necessary.
7.2 Upon the valid demand of at least 50 percentages of the organization’s members, the Executive Committee shall call a special General Assembly within a month.
7.3 The committee may call a special meeting at any time if at least one-third of members requesting such a meeting where any unforeseen circumstances will be discussed and approved.
8. The following shall be the duties, rights and responsibilities of the General Assembly:

8.1 To approve the policy and rules of the organization.
8.2 To pass annual programs and budget of the organization.
8.3 To take action against the general member or the Executive Committee member who is found to be disloyal or acting against the provision of the legislation of the organization.

SECTION-V
9. Executive Committee
The following shall be the provisions for the Executive Committee:
9.1 Chairman - 1
9.2 Vice Chairman - 4 (1-Woman compulsory)
9.3 General Secretary - 1
9.4 Assistant General Secretary - 1

9.5  Secretary - 2
9.6 Treasurer - 1
9.7 Assistant Treasurer - 1
9.8 Committee Members -11
9.9 Coordinator -4
9.10 Webmaster - 1
9.11 Assistant Webmaster -2
9.12 Media person - 1
9.13 Assistant Media person -2
9.14 Area Representatives – as required.

9.15 The person to be nominated/elected above the Treasurer's responsibility should have served the executive committee for at least one tenure.

10. All interested candidates should fill up the candidate form on their own chosen post and submit them to election committee by not later than the date and time fixed by the election committee.
11. The tenure of the Executive Committee members shall be three years.

12. The position of the committee members shall remain vacant in the following circumstances:
12.1 When written resignation is accepted.
12.2 When the member is deceased.
12.3 When the General Assembly takes action and removes him/her from the post due to being disloyal to the organization.
12.4 When the Chairman does not justify his activities in line with the spirit of the legislation or his activities do harm the organization. The Vice Chairman or the Secretary can call the meeting of the General Assembly with valid reason and the General Assembly can take the decision on the matter.

13. The meeting of the Executive Committee shall be held as follows:
13.1 The meeting of the Executive Committee shall be held twice a year.
13.2 The Secretary shall inform the committee members about the meeting with direction from the Chairman, about 2 months in advance.

14. The following shall be the duties, rights and responsibilities of the Executive Committee Members:
14.1 Draft policies, rules, budget and programs in line with the objective of the organization.
14.2 Implement the decisions taken by the General Assembly.
14.3 Determine the number of members of the Advisory Council.

15. Main functions:
15.1 When a member is in difficulty or in an emergency situation the Executive Committee will take necessary decisions on actions to be taken if so requested.
15.2 In the case of death of a member, financial support of £20 will be collected from each member of the organization.
15.3 In the case of death of a member, Executive Committee will call an emergency meeting and make a decision for an immediate financial support until the money is collected.

16. Chairman’s Duties, Rights and Responsibilities:
16.1 Run the organization responsibly and effectively as its Head.
16.2 Call the meeting of the Executive Committee.
16.3 Chair the meetings.
16.4 Implement the decisions taken at the meetings.
16.5 Appoint an Acting Chairman in his absence to carry out the responsibilities of the Chairman.
16.6 Cast a decisive vote in case of no majority on a subject in a meeting.

 

17. Vice Chairman’s Duties, Rights and Responsibilities:
17.1 Assume the duties and responsibilities of the Chairman as mentioned above in his/her absence.
17.2 Carry out activities as directed by the Chairman as well as assist him in carrying out his duties.

18. Secretary’s Duties, Rights and Responsibilities:
18.1 Call the meetings as directed by the Chairman.
18.2 Manage and conduct day to day activities of the organization.
18.3 Record and manage the minutes of the meetings and disseminate to members.
18.4 Submit the Annual Report to the General Assembly.

19. Assistant Secretary’s Duties, Rights and Responsibilities:
19.1 Carry out activities as directed by Chairman and Secretary.
19.2 Assume the duties of the Secretary in his absence.
19.3 Implement or help implement the decisions as directed in the meetings.

20. Treasurer’s Duties, Rights and Responsibilities:
20.1 Conduct financial affairs of the organization in accordance with the budget and the decisions or direction of the Executive Committee.
20.2 Keep proper records of all the assets – movable and immovable and ensure their safe keeping.
20.3 Present a balance of the finances of the organization at a meeting and Annual general meeting.
20.4 The treasure/designated property executive member is responsible for keeping a detailed account of all property including Buddha Statue in Baksila belonging to the organization. Three yearly audits of all properties/assets of the organization are to be carried out.

21. Assistant Treasurer’s Duties, Rights and Responsibilities:
21.1 Carry out activities as directed by Chairman and Treasurer
21.2 Undertake the responsibility and the duties of the Treasurer in his/her absence.
21.3 To assist to Treasurer at any time.

22. Co-coordinators’ Duties, Rights & Responsibilities:
22.1 Be present in the meetings of the Executive Committee and help by offering suggestions on the decisions.
22.2 Carry out activities as directed by Chairman and Secretary.
22.3 Help the Committee in conducting the day to day affairs of the organization.

23. Webmaster & Media person’s Duties, Rights & Responsibilities:
23.1 Day to day administration and running of the organization’s website and similar roles to other media.
23.2 Publicize the organization and its activities through the website and other available media.
23.3 Organize and assist communities as a photographer/videographer when and where necessary.
23.4 Perform all such duties as directed by the committee from time to time.

SECTION-VI

24. Financial Provision & Properties:

24.1 The organization shall have its own fund consisting of the following sources:
24.1.1 Membership fee
24.1.2 Fund raising during annual programs
24.1.3 Donations from members on happy occasions
24.1.4 Donations from donor agencies
24.2 Fund Management:
The Fund can be utilized through the joint signatures of Secretary, Treasurer and a Member nominated by the Chairman or Vice Chairman.

25. Website
The organization’s website will serve as basic platform in communicating among the members and passing information to wider community. The web address is rawakholaserofero-uk.org.
Following basic guidelines are set for the running of the website.
25.1 Members can publish their articles and activities related to the organization.
25.2 Members can publish current news & views and information relating to Rawakhola Serofero-UK.
25.3 Every single article must be censored by the chairman and the executive members prior to publishing in the website.
25.4 Individual will have to pay for following material to publish;
25.4.1 Advertisement
25.4.2 Personal business matters
25.4.3 News other than organization
25.4.4 Log in system shall be available to registered members.

26. Auditor
The Audit Report shall be presented to the General Assembly meeting prior to the handover of the next executive committee. The Executive Committee shall nominate a person to audit the accounts of the organization and prepare the Audit report.

SECTION-VII
27. Advisory Council
Advisory Council can be constituted for further advice to realize the objective of the organization, incorporating various members as recommended by the Executive Committee.
27.1 The Chairman of the Executive committee will become advisor automatically after leaving his\her post.
27.2 Any members to the public community, who can assist in the well-being and the betterment of the organization, may be elected to the Advisory committee.

28. Patron
Patron is the guardian of the organization. It is a lifetime respective appointment in the organization.

SECTION-VIII
29. Provisions of Election
29.1 Executive Committee shall nominate an Election committee before the expiry of its tenure.
29.2 Executive Committee shall fix the date for the Election.
29.3 The Election will be held in accordance with the procedures set out by the Election committee and in compliance with the legislation.
29.4 To participate in the election, the membership of the organization should be valid on the Election Day.

 

SECTION-IX
30. Impeachment and Dismissals
30.1 Those committee members who are disloyal to the organization and violate Legislation can be impeached as follows:
30.1.1 For Chairman, the majority of the total members in the General Assembly.
30.1.2 For others, the Executive Committee can file the case.
30.1.3 Every opportunity shall be afforded to such Member to clarify and defend against the accusations. No one shall be dismissed without this opportunity.

SECTION-X
31. Resignation
Chairman shall accept the resignation of the members of the Executive Committee and the Executive Committee shall accept that of the Chairman.

32. Rules and Regulations
The Executive Committee shall have the right to make and amend the rules and regulations in line with the legislation.

33. Amendment
To amend a section or clause of the Legislation, or to add an explanation, the Executive Committee shall prepare the proposal and it shall come into effect after the approval by two thirds of the members of the General Assembly.

34. Dissolution
If the organization is non-existent for whatever reason, the movable and immovable property of the organization shall be put into activities as approved by the majority of the General Assembly members.
